This text aims to demonstrate how the history of international law and scientific paradigm of modernity influenced the normative structure of this legal branch. In this sense, initially we will go through the stages of the formation of the Modern State, the concept of sovereignty and the positivist doctrine, pointing out throughout the article how such elements can be resized nowadays. The mechanistic episteme and the historical events that marked the birth of modern States are highlighted by the founding dogmatic structure of international law, which is the theory of sources exposed by article 38 of the Statute of the International Court of Justice. The immanence of this legal conception is criticized since currently both the figure of the State must be revisited and the scope of its power in (international) normative action. The methodology used is legal-normative. Secondary data is used as a result of international doctrine and jurisprudence.||O presente texto tem por objetivo demonstrar como a história do direito internacional e o paradigma científico da modernidade influenciaram a estrutura normativa deste ramo jurídico. Neste sentido, em um primeiro momento percorrer-se-ão as etapas e formação do Estado Moderno, do conceito de soberania e da doutrina positivista apontando ao longo do artigo de que forma tais elementos podem ser redimensionados atualmente. Evidencia-se a episteme mecanicista e os acontecimentos históricos que marcaram o nascimento dos Estados modernos à estrutura dogmática fundante do direito internacional qual a teoria das fontes exposta pelo artigo 38 do Estatuto da Corte Internacional de Justiça. Critica-se a imanência desta concepção jurídica uma vez que atualmente tanto a figura do Estado deve ser revisitada quanto o alcance do seu poder no fazer normativo (internacional). A metodologia empregada é a jurídico-normativa. Utilizam-se dados secundários fruto da doutrina e jurisprudência internacional.
